Jury awards $3.5 million to victim's estate

A Berkeley County jury has awarded the estate of Wanda Malmede Holland $3.5 million in a wrongful death lawsuit resulting from an automobile collision that occurred in Moncks Corner the McLeod Law Group announced last week.
On May 12, 2008 at approximately 12:42 p.m., Wanda Holland was traveling northbound on Highway 17A when Chad Kessing Sr. crossed the center line and caused a head-on collision with her Chevrolet TrailBlazer.
The evidence at trial demonstrated that Kessing’s driver’s license had been revoked on two prior occasions and that it was unsafe for him to drive an automobile. The collision with Mrs. Holland’s car was violent and killed her upon impact.
The jury returned a verdict for $500,000 actual damages and $3 million in punitive damages against Kessing.
In response to yesterday’s verdict, Mrs. Holland’s estate’s attorney Mullins McLeod said, “The family brought this lawsuit in order to vindicate the death of their mother and to help make Moncks Corner a safer place. The verdict demonstrates the jury felt strongly about ensuring their roads are safe and that drivers obey the law.”
Tonya Brumbaugh is Mrs. Holland’s oldest daughter.
“While nothing can bring my mom back, my family hopes that the jury’s verdict makes our roads safer,” she said. “We think our mom would be proud.”
